Terms of Service

These Terms govern your use of the KejaSure app and website. By creating an account you agree to them. They are governed by the laws of Kenya, including the Consumer Protection Act, 2012, the Computer Misuse and Cybercrimes Act, 2018 and the Kenya Information and Communications Act.

1. What KejaSure is (and isn't)

KejaSure is an online marketplace that connects tenants and guests with landlords, hosts, agents and service providers. We are not a landlord, estate agent, property manager or party to any tenancy, stay or service agreement.

We do not collect rent, deposits or service fees on behalf of anyone. Any payment for rent, bookings or services is made directly between users. The only payments we receive are for KejaSure subscriptions.

2. Eligibility & accounts

  • You must be 18+ and able to enter a binding contract under Kenyan law.
  • Provide accurate information and keep your login secure.
  • One person or business per account; impersonation is prohibited.

3. Verification (KYC)

Listers may be asked for ID, KRA PIN and proof of ownership or written authority from the owner. A "Verified" badge means we checked the documents provided at that time — it is not a guarantee of a property's condition or a user's conduct. Always view a unit in person before paying.

4. Landlord, host & agent obligations

  • Only list properties you own or are legally authorised to let.
  • Estate agents must hold a valid registration with the Estate Agents Registration Board under the Estate Agents Act (Cap. 533).
  • Comply with the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act (Cap. 301), the Rent Restriction Act (Cap. 296) and the Distress for Rent Act (Cap. 293) where applicable.
  • Short-stay hosts must meet any registration or licensing required under the Tourism Act, 2011 and county by-laws.
  • Declare and pay applicable taxes, including Monthly Rental Income tax to KRA.
  • Listings must be accurate — no fake photos, misleading prices or hidden fees.
  • Do not discriminate on grounds prohibited by Article 27 of the Constitution.

5. Service provider obligations

Movers, cleaners, fundis and other providers must hold any licences or permits required for their trade (including county business permits) and are solely responsible for the quality and safety of their work.

6. Tenant & guest responsibilities

  • Inspect properties and verify the lister before paying anything.
  • Never pay "viewing fees" or deposits to someone you haven't met or verified.
  • Report suspicious listings or users through the app.

7. Subscriptions & billing

Paid plans are billed as shown in the app, inclusive of applicable VAT, with receipts issued in line with KRA requirements. Subscriptions renew automatically unless cancelled before the renewal date. All subscription fees are final and non-refundable once payment is completed, including for unused or partially used billing periods. You may cancel at any time to stop future renewals; access continues to the end of the paid period. If you were charged in error, contact support@kejasure.com.

8. Prohibited conduct

  • Fraud, scams, fake listings or requesting payment for units you don't control.
  • Harassment, hate speech or unlawful content.
  • Scraping, hacking or unauthorised access (offences under the Computer Misuse and Cybercrimes Act, 2018).
  • Moving users off-platform to defraud them.

9. Reporting & enforcement

We may remove content, suspend or terminate accounts that break these Terms, and may share information with the National Police Service or other authorities to help investigate fraud.

10. Limitation of liability

To the extent permitted by Kenyan law, KejaSure is not liable for disputes, losses or damages arising from agreements or payments between users. Nothing in these Terms limits rights you have under the Consumer Protection Act.

11. Intellectual property

The KejaSure name, logo and app are protected under the Copyright Act and Trade Marks Act. By posting content you give us a licence to display it on our platform for the purpose of providing the service.

12. Privacy

Our use of your data is described in our Privacy Policy, in line with the Data Protection Act, 2019.

13. Disputes & governing law

These Terms are governed by the laws of Kenya. We encourage resolving disputes by contacting us first; unresolved disputes may be referred to mediation and, failing that, to the courts of Kenya.

14. Changes

We may update these Terms. Continued use after changes means you accept the updated Terms.
